TERMS AND CONDITIONS


1. VEHICLE WARRANTY AND EMISSIONS

A vehicle modified by the use of performance parts and tuning may not meet the legal requirements for use on public roads. Use or installation of performance parts and tuning may adversely affect the drivability and reliability of your vehicle, and may also affect or eliminate your insurance coverage, factory warranty and new OEM part warranty. Performance parts are sold as is without any warranty of any type. There is no warranty stated or implied due to the stress placed on your vehicle by performance parts and our inability to monitor its use, tuning or modification.

2. PROCESSING TIME (ONLINE ORDERS)
Please allow for 48-72hrs for all online orders to be processed. Thank you for your patience.

3. PRODUCT RETURNS
Mega 3 Performance takes great care to ensure our customers receive the proper products to suit their individual needs. For any number of reasons, a purchase may not meet those needs and may require an exchange or in some cases a refund. You are encouraged to contact a Mega 3 Performance Representative prior to returning a product as you may find additional information about the product and related products helpful.We are happy to accept your returned merchandise so long as the following criteria are met:

  • All returns must be pre-authorized by contacting an M3P representative at 704-710-6010
  • All returns must be sent AFTER contacting M3P for an RMA number.
  • Once that RMA number is given the following form must be filled out before shipping the product back: M3P Returns Form
  • Returns must be sent to the address below
  • All returns must be received by M3P within 30 days of the date in which the product was shipped
  • All returned merchandise must be in new, unused condition and in the original package or box.
  • All returned merchandise must be shipped with the M3P issued Return Authorization (RA) number clearly marked on the exterior of the shipping carton or other packaging.
  • Special Order items will not be accepted for exchange or return unless previously authorized by an M3P representative. M3P Reserves the right to require a 15% restocking fee for all returns that are not damaged or incorrect.


Please be sure to adhere to the criteria specified above as any return that does not will be ineligible for credit or exchange and will be refused or returned to the sender. Shipping charges for returned merchandise are the responsibility of the customer. Original shipping costs are not refundable. Exchanges are subject to product availability.

4. LIMITED PRODUCT AND LABOR WARRANTY
This warranty applies to M3P parts and begins on the invoice date of part purchase and ends twelve (12) months or 12,000 miles from that date, whichever occurs first. Due to the variety of modifications and changes made to cars and/or engines that may affect the performance or durability of related components, M3P’s obligation under this warranty extends solely to the repair or replacement parts manufactured by M3P.

This warranty applies to M3P’s labor and begins on the invoice date and ends twelve (12) months from that date. M3P’s obligation under this limited labor warranty extends solely to the labor required for the repair of components or systems deemed by M3P to have been damaged as a result of an M3P employee’s negligence during installation of those components, systems, or existing components and systems.

All warranty returns must be pre-authorized by contacting M3P at (704) 710-6010. Parts deemed under warranty will be repaired or replaced by M3P at no cost to the customer. Payment of the cost of labor related to said repair/replacement is at the sole discretion of M3P and will only be covered by M3P where the M3P part or parts were originally installed or service was performed at the M3P facility located at 118 Poplar Pointe Drive, Mooresville, North Carolina, 28117. Labor/service performed at any other facility is at the sole discretion of that facility and is excluded from this warranty.

To file a warranty claim, M3P or the authorized dealer must be notified and the vehicle and/or part must be brought to M3P or the authorized dealer within seventy-two (72) hours of discovery of the defect, where feasible. Any returned merchandise shipped to M3P must be shipped with the M3P issued Return Authorization (RA) number clearly marked on the exterior of the shipping carton or package. Shipping charges to and from M3P are the responsibility of the customer.

To file a warranty claim, the part must be returned with proof of purchase, the customer name and address, type of car, year, odometer reading, and VIN number, the installation and removal date of the part, and the date the part was delivered. No claims will be considered without the aforementioned information and the original M3P part. Return freight charges must be prepaid. Collect charged returns will not be accepted. All parts replaced under warranty will become the sole property of Mega 3 Performance.

4a. EXCLUSIONS
Parts showing evidence of misapplication, abuse, misuse, improper maintenance, neglect, alterations from their original configuration, or failure to follow installation instructions are expressly not covered by this warranty.M3P reserves the right to make changes to products, packages or specifications at any time without obligation to modify earlier installed products, packages or specifications. No person, company, or other organization is authorized to assume for M3P any warranty responsibility or make binding judgments regarding warranties of any parts, which from time to time may become subject of a warranty claim.


The M3P Limited Product Warranty further excludes the following: Transportation and shipping charges, towing and rental car charges, damage to a component or assembly due to installation of replacement parts with specification(s) that differ in any material respect from the original vehicle manufacturer’s or M3P parts, damage resulting from the modification of an M3P part, damage resulting from the use of other manufacturer’s products in conjunction with M3P’s products or systems, damage to clutch or transmission components, maintenance services and parts when replaced during maintenance such as spark plugs, lubricants, fluids, engine tune-up parts, replacement filters, coolant and refrigerant, mechanical adjustments or repairs which result from normal wear and tear, drive belts, light bulbs, damage due to the failure to perform maintenance services at the specified intervals or in accordance with the instructions in the owner’s manual from the original vehicle manufacturer or M3P product instructions, damage attributed to negligence, improper installation, improper treatment contrary to the instructions in the owner’s manual from the original vehicle manufacturer or M3P product instructions, damage resulting from improper or contaminated fuel, damage to an M3P component as a result of a collision or repair, any vehicle/products operated and used in a competitive event, custom designed competition parts, incidental and /or consequential damages, including loss of time, inconvenience or loss of the use of the vehicle.


M3P’s Limited Package Warranty applies only to M3P vehicles and M3P products and packages sold and/or installed through M3P Preferred Dealers and Installers.


5. M3P ECU TUNING TERMS
We fully support our products, as well as the system, processes, and procedures that have been tested on many platforms. If you do not follow the instructions that are emailed to you when you receive your new file and/or ECU, you risk the possibility of damaging the ECU. We cannot control issues pertaining to customers' internet connections, computer abilities, other laptop programs, corporate security, etc. If you encounter errors and would like advice on what that error is caused by, you can email or call us directly for troubleshooting.

Once a handheld Powergate 3 OBDII programmer (purchased through us) is plugged into your OBDII port and you read out the car's stock file, the handheld is then locked to the VIN of that car and cannot be returned. If you do decide to cancel your flash tune order and have done this process and not received a tuned file, a fee of $300 will be deducted from the refund amount to cover the handheld cost.

Dealer ECU slave programming kit comes with a twelve (12) month warranty against defects. Dealer slave programming kit cannot be returned once purchased by an M3P dealer. An M3P dealer can sell and transfer their slave programming kit to another dealer. Any and all fees or costs associated with the transfer of a slave programming kit license is not the responsibility of M3P.

There is NO WARRANTY on ECU tunes. All files are good working calibration files that have been dyno developed, rigorously tested and used in cars worldwide. Please understand that mechanical issues, improper performance part combinations, not following the directions, and "Butt Dyno" reactions are not our responsibility. After 30 days the flash tune purchase cannot be cancelled or refunded.

6. McLAREN HIGH PERFORMANCE POWERTRAIN LIMITED WARRANTY
This warranty applies to M3P engine and/or transmission programs and begins on the invoice build completion date and ends twenty four (24) months or 24,000 miles from that date, whichever occurs first. Due to the variety of modifications and changes made to cars and/or engines and transmissions that may affect the performance or durability of related components, M3P’s obligation under this warranty extends solely to the repair or replacement of a package or packages manufactured, installed and/or sold by M3P.

All warranty claims must be pre-authorized by contacting M3P at (704) 710-6010. Parts/packages deemed under warranty will be repaired or replaced by M3P at no cost to the customer. Payment of the cost of labor related to said repair/replacement is at the sole direction of M3P and will only be covered by M3P in the event the M3P part or parts were originally installed or service was performed at the M3P facility located at 180 Commerce Boulevard, Statesville, North Carolina, 28625. Labor/service performed at any other facility is at the sole discretion of that facility and is excluded from this warranty.

To file a warranty claim, M3P or the authorized dealer must be notified and the vehicle and/or part must be brought to M3P or the authorized dealer within seventy-two (72) hours of discovery of the defect, where feasible. M3P’s Limited Package Warranty applies only to M3P vehicles and M3P products and packages sold and installed by M3P and/or M3P Preferred Dealers and Installers.

6b. MILEAGE AND TESTING
Once the car is assembled and ready for testing and/or calibrations, the car will log miles on the odometer. Drive cycles, break-in cycles, heat cycles, and dyno testing may need up to 2000 (two thousand) miles to complete the build. Client understands and agrees to the necessity of mileage and gives permission to M3P to put miles on the client's car. Clients will maintain proper vehicle insurance, vehicle registration, and license plates up to date so that M3P can conduct roadworthy testing on the client's car when necessary. If and when closed-course testing is needed, the client will be informed when and if this will be conducted. All client vehicles are covered under Mega 3’s garage liability insurance policy that protects the vehicle from fire, theft, and damage while in possession or under operation of Mega 3. The garage liability policy will not cover a client’s vehicle if damage is caused by another motorist, acts of God/nature outside of M3P’s facility, or if the vehicle is struck by an animal and/or debris during road or course operation.

7. SHIPPING
Shipping, insurance and handling charges are added to the invoice and are the responsibility of the consumer. Expedited shipping services are available at an additional cost. The shipping charges indicated at “checkout” are based upon the actual weight or “DIM weight”, depending upon the size of the package. Actual shipping charges may vary from the reference rates provided at checkout but will be specified on the Mega 3 Performance invoice and confirmation email following submission of your order. UPS does not ship to PO Boxes.

APO and other Military addresses may be declined. Please contact Mega 3 Performance for further information.

Other Foreign Countries: M3P has many international dealers who will happily process your order for M3P products. If you do not have a dealer local to you, purchasing direct is acceptable. M3P cannot accept international credit cards. For international purchases, M3P requires a bank wire transfer. All applicable fees, duties and taxes are not assessed by M3P and are the sole responsibility of the customer. Please contact Mega 3 Performance for further information.

Billing and Shipping Address: The “ship to” address must match the “bill to” address. M3P can only ship to the credit card’s billing address. Please be sure to notify your financial institution of your most up to date address. There are no exceptions made on this particular policy when paying via credit card. We offer many secondary payment methods which circumvent this requirement. Please contact Mega 3 Performance for further information.  

8. TRANSACTION FEES, CHARGEBACKS, & STORAGE CHARGES

Any customer payment returned for insufficient funds will incur a $99 fee in addition to their original invoice balance due. Customers must resubmit their payment balance within 24 hours. If customers fail to complete their payment before the 24 hour period, customers will be subject to a daily nonpayment penalty of $99 per day until payment is completed successfully. Customers cannot collect their invoiced items and/or vehicle with installations or service performed until all payments are completed by M3P and there is a zero balance due on customers invoice.


M3P customers agree to not file chargebacks in favor of doing business with M3P. In the event of a disagreement on work performed, invoiced items, and/or pricing the customer will contact an M3P representative to file a complaint. Once the complaint is reviewed by an M3P representative then a resolution will be presented to the customer who filed a complaint. If any customers choose to file a chargeback on their payment(s) after having agreed to the M3P Terms & Conditions, they will be subject to a $999 fee added to their outstanding balance equivalent to their chargeback amounts. For each 24 hour period a chargeback is not paid by customers then a $99 per day penalty will be charged to the customers balance due. After 30 days from the customers original invoice due date, any chargeback plus penalties that are not paid to M3P then customers agree to assume all costs of M3P's legal remedies such as but not limited to personal property liens, legal charges, monetary damages, legal fees, attorney fees.


Any customer vehicle that is not collected by its owner after 5 days of completed services by M3P, a daily storage fee of $75 will be added to customers invoice balance. After 10 days, M3P will file a mechanics lien on the customer vehicle.


9. VEHICLE WARRANTY AND EMISSIONS
A vehicle modified by the use of performance parts and tuning may not meet the legal requirements for use on public roads. Performance parts and/or packages are sold without any emissions warranty of any type. There is no emissions warranty stated or implied.

10. PRICES AND SPECIFICATIONS SUBJECT TO CHANGE WITHOUT NOTICE


11. RACE / COMPETITION / INTERNATIONAL USE ONLY
Mega 3 Performance products are designed for installation on race-only vehicles, defined as a vehicle that is used exclusively for competition and that cannot be licensed or registered for use on the public roads and highways within the United States. Mega 3 Performance products are not available for sale on emissions-controlled vehicles within the United States. International users outside of the United States should act in accordance with their local laws and regulations.
